i tried but i really do just want to see that one and she said oh, i don't want to hurt your feelings and i said okay. thank you so much. you are probably right. i can't afford it i walked out of the store. now why did she do that. >> bill: because she is a moron. i believe every american has been insulted in a store or restaurant at some time. when that happens you do as ms. winfrey did. walk out. later call up and complain to the owner much the property. oprah was heavily implying that the disrespect shown her was racist. the clerk involved denies that ms. winfrey also said this about her current status. >> sometimes i am in a board room or i'm in situations where i am the only woman, i'm the only african-american person within 100-mile radius. can i see in the energy of the people there, their -- they don't sense that i

should be holding one of those seats. i can sense that. >> you do? >> of course can i sense it i can never tell. is it racism or sexism? ms. winfrey has gotten a lot of heat for her -- talking points believes her critics are misguided. that is her experience and she has right to express her opinions about it the truth is there are racists. there are men who don't like women holding power there are loons running around. here is the most important part of the story. oprah winfrey and everyone else should ignore those troglodytes. a foolish insult is not serious. the truth is you are not going to change the minds of the ignorant and it's not worth the effort in any case. to internalize this kind of stuff is destructive to a human being. as we have been reporting, there is a huge grievance industry in america pedals

victimization all weekend long. what good does that do? oprah winfrey is the best example of a talented person who made it oher own in america. she is now one of the most powerful human beings on the planet. her color certainly didn't hold her back from achieving that if some idiot shop clerk insults ms. winfrey, that's wrong but no big deal. oprah can get on a private jet and fly anything she wants to buy anything she wants. she has made it in america because she worked hard. and used the talent god granted her. summing up, the victim hood card is useless to oprah and to everybody else. there is racism in the world. it's not going away. if you can change it, try. but most of the time ignore it. don't let it dampen your life. and that's the memo. now for the top story tonight. reaction. joining us from new orleans, fox news anchor arthel neville and chief religion correspondent lauren green with us here in new york city. where am i going wrong here, lauren. >> actually i don't think you are going wrong.

only problem is you weren't there, i wasn't there we don't know what transpired between these two. i go belief things like this happen all the time. it happened to me it happened in sax fifth avenue. the first thing the clerk said to me how much it costs. that's a problem. i said, okay. and i walked away. i don't noe one said anything. i didn't make a deal out of it things like that happen. do i believe that the critics are wrong in saying that she overreacted. i think people need to know that things like this do happen. >> bill: why do people need to noe that. >> racism isn't like something calling the "n" word. usually something more settle like that. i have experienced it. my sister-in-law has experienced. but, you have two choices when you go into experiences like that. can you either make the situation worse or diffuse it. >> okay. but hasn't everybody as i said in the talking points memo been insulted by a clerk in a restaurant? hasn't everybody of every color been insulted? >> i don't know. but you know what? people look ought, you are the top of the food chain

do what she did. walk out. >> okay, great, then i agree with you. so, next? >> bill: okay, next is, is it worth basically as lauren said pointing this out and, if so, why? >> in this day and age, we pretty much chronicle mostly everything we do via twitter. all oprah did was send out a tweet and said hey, tried to get a bag. lady thought i couldn't afford it walked out. >> bill: she said where the shop was, too. >> that's the point she didn't want to put the shop on blacklist. she didn't want to make a big deal about it it. >> bill: how is the problem going to be solved? everybody knows who the shop is now. >> she wasn't trying to solve be a pro. oprah was doing as someone we know well and pretty much everybody in the entire world that would say who knows oprah she is very trustworthy. i think what she was doing is simply saying the elephant is in the room. weave can't ignore it she certainly wasn't trying to put a bigger wedge in the racial divide pie if you will. she said look, if it happens to me it could happen to everybody. she is not trying to promote racism she is

putting a face to it. >> i understand and i said there is nothing wrong saying what she said. that was her persons examine. i said that quite clearly. however, this stuff does feed the victimization industry, the grievance industry it feeds it it and it gives people a reason to fail. >> i don't know about that. >> bill: of course it does. absolutely does. >> i'm still trying to get over the fact that there is a purse on sale for $38,000. i'm still stumbling over that right now. the fact of the matter is, oprah winfrey is worth $3 billion. she is a very smart woman but doesn't -- the point is i don't think that she was trying to play the victimization card. >> it can be used that way. >> other people might have used it but she did not use it. she is a sensitive person. does moo mean she doesn't have the right to say something that offended her. i think she had the right to say that. >> quite clearly she has the right to do it. i disagree with both of you if you don't think that this is going to be used by the receive grans industry and racial hustlers to see oprah winfrey, see, they

are all against it: turn it around oprah winfrey: oprah winfrey is the most successful woman in the united states and she is black. so it doesn't add up. go ahead. >> listen, there you are right it doesn't add up so because you are trying to put in this equation doesn't make sense. okay? this is what i think people should understand that, of course, oprah, myself, i can't speak for them, oprah or lauren, i think they would agree with me that no one wants to sanction excuses. no one wants to do that that's not what we're doing here. >> it's done all the time. the grievance industry pedals a victimization theme that allows people to say oh, i can't succeed because i'm black. they do it taught time. and you know it. final word? the taksimization industry is one of our big themes here. because of i file that this holds african-americans and every minority back. and whites, too. oh whoa is me. society won't let me succeed. this is what i want to get

however, in september of 2011, just 11% of us were satisfied. so, we're not at the -- with the vast majority of americans not liking the direction of the country, the question becomes why. joining us now from washington. republican strategist kate obenshain. also kirsten powers a democrat and fox news analyst. powers, what's the main source of disenchantment? >> well, i'm not sure that there is one source. i think that, certainly, the economy is a piece of it. but, the economy is turning around. we are in a recovery, believe it or not, but i think a lot of people still feel like their lives are not that secure. and as long as you are feeling like your life is not that secure, most people don't have pensions anymore. they are not sure about their health insurance. they are not sure that they are going to continue to have a job because everything has become so unpredictable. so i think it's environment sort of set up for people to be dissatisfied. >> bill: it's all

environment? >> i think there is economic component. i agree beverage that kirsten just said believe it or not. i also think it's a lot broader than that political to some extent. the ongoing scandals been ace . we are seeing nothing happening. obama care clear special interests are still in control of washington despite promises. but, bill, i think it's even broader than that we have a president who sort of is pedaling victimization, encouraging americans to be divided. i wrote a book on it obama is the divider in chief. he turns americans against each other based on income, race, sex, whether they are immigrants or not. is he pitting us one against the other. that transition -- that translates into this sort of overriding animosity and despair and dissatisfaction. it's intentional. then he gets to ram through his bigger government. i think it's a more cultural thing. the president's job approval rating is about 45% now. so the 22% number doesn't

jive with we don't like obama business. i think it's basically that americans are seeing their country change, powers. change dramatically. and we have been reporting on this. and they don't like it. >> change how? >> they don't like the trayvon martin case. they don't like the entertainment industry. they don't like the disrespect shown by younger americans. they don't like the machines taking over everybody's lives. they are losing a sense of what it is to be an american. and i really think that's really people are is it starting to get like this about, yes, the economy is shaky and it hasn't really improved and there is not a lot of security in the marketplace, that's right. but it's more about this country is not what i grew up in. powers. >> honestly, i feel like that's the gripe of almost every generation through all time. there is always the complaining the kids are being too disrespectful and hollywood is ruining moses. >> if you look at the numbers now.

if you look at the behavior now, what's happening now. that is a legitimate gripe. >> look, i think it's -- i think it's always ban legitimate gripe, frankly. it's just as much a legitimate gripe today. i don't think that is necessarily a new gripe. but i do think the part of what kate was just saying. the feeling that we have these problems and then we have these people in washington who don't really seem capable of actually doing anything are always disagreeing. >> bill: you are so beltway oriented, powers. i know you live there and you breathe it and you love it. but it's beyond the beltway. people don't think about congress. they are not thinking about obama all the time. they are thinking about their own lives. what matters to them. and they are seeing everything change. the whole thing. >> i think a certain -- but i think you are talking about an older generation. you are right. i think a lot of people do feel uncomfortable with. >> it's not just older

generation. it's even people 30 and up that are saying to themselves, you know, look, kate, when you talk about the victimization, we talked about how the country is being divided. you just said you believe obama is the reason for it. i think he is one portion of it. but i think the media is the primary divider in this country now. i think the media is embracing now, really horrendous. go ahead. >> i believe the media accept bracing obama's message. they love obama's message. look, bill, the young people, this the is first time that young people have thought that their future is going to be less full and prosperous than their parents. that is, because, for one, their economic outlook is bleak. but obama is telling them that because of big business. because of greedy people they are never going to get anywhere. is he telling women that they can never get anywhere about the magnificent hand of government reaching down. is he telling it the middle class you will never achieve anything unless

government helps you. it is the sort of animosity you mentioned trayvon martin. he is he making the racial divide clearer, stronger, more distinct instead of saying hey we americans are moving forward. it's this intentional stirring up of animosity but, class warfare, racial warfare, gender warfare, obama is -- that doesn't mean they don't like obama with you it's his message that is so pernicious in getting into society. >> bill: i will buy that that this whole thing is coming together and people feel uneasy with the tone. with the tone. >> you are miss -- >> half the story. >> bill: i have got to go, ladies, we will continue. this but i think it's the tone of the country that's got people on the negative along with the economy. directly ahead, attorney general holder says the war on drugs has been a failure and he is not going to prosecute retail drug dealers aggressively. later, ms. teen u.s.a. says she was hacked in her own

>> bill: in the factor follow up segment tonight, on monday, attorney general eric holder gave a speech in san francisco where he said the war on drugs is not working. >> as the so-called war on drugs enters its fifth decade, we need to ask whether it and the approaches which comprises has been truly effective. it's clear as we come together today that too many americans go to too many prisons for far too long and for no truly good law enforcement reason. >> now, that is a liberal line and here now to reply to mr. holder, peter van singer, former evidence the drug enforcement administration who joins us from chicago. so, as you know, this is what the left is putting out there, that we are a punitive society and

unjustly putting a lot of people in prison for too long for quote, unquote, nonviolent crimes. and you say? >> and i say that the attorney general is wrong on the facts. in fact, the 1979, when i was administrator of dea, 25.4 million people who are using illegal drug at least once a month. the last reported period, 2011, that number was 22.5 million. users of illegal drugs and our population, bill, went from 225 million to 305. instead of 11% of the. legs, using illegal drugs, we are down to about 8%. too many, but that's a 30% decrease. that's success. >> saying that because of a lot of education. enforcement and increased awareness. i think ronald reagan's

parent group movement. clearly, certainty of punishment, which the attorney general in san francisco moved away from is also a factor. >> bill: okay, now, the crux of the matter is that holder and the left believe i bet you do, too. explain why. >> because it's not a victimless crime. people are dying. three will die from cocaine today. >> that's an individual choice though. they say those people want it and it's their fault, not the dealer. >> bill, this is poison that people are selling that is costing lives. causing accidents, losing productivity. and the guidelines at the a.g. has put out and i have read them, that he sent to the u.s. attorneys are not going to change the way people go to prison. because the dea agents and

the federal prosecutors are not putting in prison retail dealers. they are putting people in prison who are part of a gang, part of a cartel who have a long criminal history. >> bill: what about all the marijuana people in prison? that's what they point to the poor pot heads they are rounding up. >> let me tell you there is less than 1% of the state prisons full of people that are in prison for the use or possession of marijuana. >> bill: less than 1%. the other thing is they say they target blacks. they target black americans. they put them in jail. the blacks and whites use cocaine at the same amount. far more blacks in jail on drug offenses. >> there are more people committing crimes in certain neighborhoods that often are black neighborhoods than in white neighborhoods. >> this is all about eric holder and the left wanting to legalize drugs. that's what it's all about. if you can bring down. all right, the outrage of the american people against drug dealers, against drug use, hard drug use, feel

>> bill: washington beat sessionment tonight, we have two interesting situations beginning with the real reason attorney general holder is talking about lightning up on the prison population. joining us now from washington, ace correspondents carl cameron and james rosen. rosen, tell me about holder. what's real little driving this thing? >> bill, some people thought that this announcement, this flash announcement the american bar association by the attorney general was really driven by politics to

accomplish two short-term goals. the first is to move the attorney general past some very high profile recent controversies, amply documented on our channel and also to placate certain core constituencies of president obama's by framing these issues as having to do with communities of race and color and so forth. lending some credence to that view is the fact that really what attorney general holder announced is going to have rather little impact on crime and punishment in america as we know it today. >> bill: the states are doing most of the prosecution. >> 95% of them. only 5% of criminal prosecutions are handled at the federal level. and those state and local prosecutors had 0,000 of them across the country say they are already exercising the kind of discretion the attorney general called for in both charging documents and in sentencing recommendations. one further point is that the practical effect of this may be to encourage certain prosecutors to omit key information from charging documents like the volume of a given drug

that. >> bill: don't put the weight down on the retail drug offenders. >> if you are a criminal defense attorney and caught omitting that kind of information, that could actually put you on the wrong end of the law. >> bill: this was such a mistake by holder. such a huge mistake. that's why we are doing the story. egypt, talk about a chaotic situation. you are at the state department, rosen. anybody know what's going on over there? >> well, we just heard directly from secretary of state kerry himself who made a hastily arranged appearance in the press briefing room delaying the briefing by about an hour. he said that this is a serious blow to hopes for stability which i guess is stating the obvious. kerry said he still thinks that there is some room for for maneuvering for these two sides in this increasingly hostile situation to move towards reconciliation. he said that path remains open but it's much harder. >> bill: that's bologna. look, the islamic brotherhood morsey. couldn't run the country. the economy is in a shambles. they don't care about the economy. they care about allah.

all right. and then the army is saying, look, you know, we have got to get the tourists back. in we have got to calm this down. there is no detente. who is the u.s.a. going to throw in with? they have got to throw in with the army but it disund doesn't seem like saying that. >> detaunt is run french tourism to throw around here. the other is coup deta. state department and the white house today actually came out and said we don't have to make a determination about whether this was a cudahy that. >> of course it is. what a mess. let's get to the irs deal. now, congress is on its, what, sixth month vacation. just before thanksgiving. then they will go up again and then they will be back just before christmas and then go up again. what are they doing with the irs? what's the house doing with the irs? >> well, republicans want an impartial irs. and some degree of accountability for their admitted screw ups in the last couple of years. the irs says it has actually stopped using those be on the lookout or

bolo list to target conservative groups seeking tax exempt status. a front line application screener told congress recently even thought those so-called bolos conservative groups are being subjected to greater scrutiny. as a practical matter the policy hasn't changed. >> bill: i want to get this lois lerner on the record. is there any movement towards this? this is the villain, this is the woman who knows, who ordered her to do this. she is the key. are the pinheads in congress going to get anything out of this woman? >> well, they haven't gotten anything from her yet because she took the fifth amendment. she refused -- she cited her fifth amendment rights to not testify before coming there has been some talk about giving her immunity in order to get her to say what actually happened but she hasn't. now it turns out that the house government reform and oversight committee chaired by darrell issa says it has found at least one email from lerner that was official business in her private email accounts. and that, they say, smells bad and raises big questions.

so, mr. issa has said he is going to give ms. lerner until the end of the month to cough up all of the documents in her private email accounts. >> bill: she is not going to do that the lawyers aren't going to do that. >> there is a couple things in the way there you have got things like the federal documents act that require officials to make sure and make available any official business even if they do use their private email accounts. this could get ugly for her. that's not the only thing that's going on here. there is a separate problem that has been revealed of late. and that is this absence of any new changed policy in the irs. the idea that a guy in cincinnati where this scandal actually originated where it was originally discovered that these applications for tax exempt statutes are being delayed he says they haven't changed it congress wants immediate action on that. given the irs four days to explain it. >> bill: all right. we will of course follow everything, gentlemen. we come right back, dennis miller running riot. i mean that literally. miller is next.
